The issue of somebody suing an individual is a common one. When filing for bankruptcy, the legal proceedings relating to this are halted. The question that typically follows is what happens to the claim or debts owed by the individual?


Generally, bankruptcy wipes out these debts, with some exceptions. Child support, student and HELOC loans, court fines and other small categories of debt are not eliminated. The majority of debts, including those for which someone may be sued, are wiped out by bankruptcy, so long as the debt was incurred prior to the date of bankruptcy.
